Question
You plan to fly your single-engine aircraft to an airport that is located under the 10-nautical-mile outer airspace ring of a Class C airport. The aircraft does not have a transponder. Can you make the flight into this airport, as long as the Class C airspace is not part of a larger airspace complex such as underlying Class B airspace?
Answer
Because a transponder is not required underneath the outer shelf of Class C airspace, you would be able to make this flight with no transponder. However, keep in mind that a transponder is required inside Class C airspace and above the Class C airspace up to 10,000 feet msl. Also remember that if you are flying an aircraft equipped with a transponder, FAR 91.215(c) requires that you operate that transponder, including Mode C (if installed), anytime you are in controlled airspace.
