Airport Noise Curfew Act of 2005

The Issue

Representative Joseph Crowley (D-N.Y.) introduced legislation (H.R. 455) in the 109th Congress that would establish a commission to study and make recommendations regarding the establishment of curfews for civil aircraft over populated areas.

Representing Queens, N.Y., Representative Crowley has been a strong advocate for an 11 p.m. curfew for La Guardia Airport.

Major Provisions

The "Airport Noise Curfew Act of 2005" (H.R. 455) would establish a commission comprised of nine members — only two of whom are representatives of the aviation industry. The commission can hold hearings, issue subpoenas, and obtain data from federal agencies. The commission would be required to submit a report of its findings to Congress six months after enactment of the act.

AOPA Position

Noise issues at La Guardia should not move airports nationwide to usurp existing Federal Aviation Administration (FAA) regulations concerning the establishment of an airport curfew. H.R. 455's use of the term "populated areas" could apply to flights not associated with a major airport, including quieter piston aircraft operating to and from reliever and general aviation airports in a metropolitan area.

Rather than enact this legislation, the association supports voluntary noise abatement procedures and encourages "fly friendly" techniques.
