You'd be nuts to fly without the legal protection. A good attorney is expensive; retaining one for an action brought by the FAA far exceeds the cost of the program. I learned this the hard way when I was subject to an "ambiguous controller instruction." I was out several thousands of dollars in a wink of an eye. My attorney was a panel attorney for AOPA’s Legal Services Plan and most of that cost would have been covered. The controllers were wrong, but that didn't mean I didn’t have to defend myself.
