Section 2210 interferes with the state and federal funding process. For airports, this is a serious impediment on the state’s ability to comply with contractual obligations entered into between the state and the Federal Aviation Administration (FAA), when Pennsylvania was awarded State Block Grant Program status. Furthermore, Section 2210 conflicts with Act 1984-164. This act requires that the funds collected through the collection of aviation fuel taxes and used for airport development be achieved without exclusion or discrimination.
Action taken by the Pennsylvania legislature to restrict airport development through legislation is unprecedented and restricts the use of federal and state funds on airports without the approval of the municipalities involved, creates an obstacle not only to the state’s ability to maintain and enhance its 149 public-use landing sites, but also impedes federal funding of airport development in Pennsylvania. Fortunately, Representative Russ Fairchild understands the inequity of this legislative action and introduced legislation to repeal Section 2210. The bills, House Bill 1895 and 1896, were introduced on September 28 and are now assigned to the house Transportation Committee.
