Question

Can a flight instructor with an expired medical certificate provide instruction if the customer acts as pilot in command? The CFI has to be in the airplane to give instruction, so isn't he or she technically "required" for the flight according to FAR 61.23 (a)(3)(ii), thus requiring a medical certificate?
Answer
According to two FAA letters of interpretation (LOI), the FAA doesn't consider a CFI to be a required crewmember for this flight. This 1995 LOI covers this question thoroughly. This 2010 LOI defines a "required pilot flight crewmember" as "a pilot assigned to perform a duty in an aircraft during flight time" and explains that "an instructor is a required pilot flight crewmember if the person receiving instruction is not qualified to act as pilot in command or if the type certificate of the aircraft on which instruction is being given requires more than one pilot flight crewmember and no other qualified pilot is on board."
